What is an uncontested divorce?

Uncontested divorce is regulated in paragraph 3 of Article 166 of the Civil Code. Provided that the marriage lasted at least one year, if the spouses apply together or if one spouse accepts the other's case, the marriage is presumed to have been broken down from its foundation. In such divorce cases, the parties make a protocol on the financial consequences of the divorce and the situation of the children after the divorce. The judge may find this protocol appropriate or will make changes taking into account the interests of the parties and the interest of the children. If these changes are accepted by the parties, the judge rules the divorcement of the parties.
